SUBJECT: Allowable Transfer of WIA Title I Funds
 

Background:  Section 133(b)(4) of WIA states:

A local board may transfer, if such a transfer is approved by the Governor, not more than 20 percent of the funds allocated to the local area under paragraph (2)(A) or (3), and 20 percent of the funds allocated to the local area under paragraph (2)(B), for a fiscal year between:

  1. adult employment and training activities; and
  2. dislocated worker employment and training activities.

This memorandum provides the procedures for the transfer of funds between adult and dislocated worker programs at the local area.

Procedure:  The Connecticut Department of Labor, in governing the transfer of funds, will use the following procedure.

  1. Transfers can be requested in the categories and with the limitations contained in Attachment 1 to this memorandum.

  2. A transfer of funds request package (Attachment 2) must be submitted for each request for transfer of funds.  All parts must be completed.

  3. A transfer of funds request may be submitted for consideration at any time during the life of a particular year’s allocation, as stipulated in the contract.

  4. Once the funds are transferred, they are available for expenditure in the receiving funding stream and are subject to all corresponding rules, regulations, and procedures.

  5. The transfer for funds request must satisfactorily address all supplemental questions contained in the package.

  6. As part of the supplemental requirements, local areas must provide for a minimum 15 day period of comment to the public and area stakeholders before a request is submitted.  This can be done through publication of the request in local area newspaper(s).

  7. The Connecticut Department of Labor shall approve or disapprove a local area request for transfer within thirty (30) days of receipt of the request and all necessary supporting information.  If action is not taken within the thirty (30) day period, the request is deemed to be approved.  Action also includes, in addition to approval or disapproval, any inquiry or request for additional information or clarification.

  8. Expenditures shall be reported in accordance with CT Department of Labor  Memorandum AP 00-17; and cash is drawn in accordance with AP 00-03.
