SUBJECT: WIA Dislocated Worker Eligibility Determination

Background:  On August 7, 2000, AP 00-16 was issued regarding WIA dislocated worker eligibility.  The WIA-5 form attached to the memorandum had an error under category B. 3.  The revised WIA-5 is attached and should be used in place of the old form.

Policy:  The WIA-5 form, Eligibility and Certification for Dislocated Workers Under the Workforce Investment Act, Category B. 3. should read,

“For purposes of eligibility to receive services other than training services described in section 134(d)(4), intensive services described in section 134(d)(3), or supportive services, is employed at a facility at which the employer has made a general announcement that such facility will close;”

It is unlikely that this category would be used to certify dislocated workers, as the services available to workers under this category are the same as services that are available to any individual using a One-Stop Career Center.
