SUBJECT: Certification of Dislocated Workers

Background:  On August 7, 2000, AP 00-16 was issued regarding dislocated worker eligibility to bring more clarity and consistency to the process of certifying dislocated workers under the Workforce Investment Act.  This document includes additional information, which will assist the certification process.  This document addresses release of Unemployment Insurance information, the definition of "underemployed" and documentation for profiled individuals.  A modification to AP 00-21 is also being made.  It adds document verification which may be used to substantiate "Unlikely to return to previous industry or occupation." 

Unemployment Insurance Records Release 

Attached is an Unemployment Insurance Records Release form, DOL-37.  It allows for the release of a client"s unemployment information to partners within the One-Stop system for the purpose of determining eligibility and maintaining documentation for the Workforce Investment Act or job training programs. 

Definition of Underemployed 

The fourth condition of possible certification as a dislocated worker for purposes of WIA is "a displaced homemaker".  Certification under this area is covered in AP 00-16.  Below is the addition of the definition of "underemployed".

For the purpose of this certification "underemployed" shall mean: 

  1. A person who is working part-time but is seeking full-time (35+ hrs/wk) employment; or 

  2. A person who is working full-time but whose current annualized wage rate (in relation to family size) is not in excess of the higher of either the poverty level or 70% of the lower living standard income level. 

Acceptable verification documentation is on the verification matrix in AP 00-21. 

Certifying Profiled Individuals 

Individuals that have been profiled and are being certified as dislocated workers are required to have the same documentation as all other people being certified as dislocated workers.
